The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 406, 420, 467, 468, 471, 120(B)/34 of the Indian Penal Code. As per FIR, the allegation against the petitioner is engaging in the commission of Cyber cheating through several mobile phones. The petitioner is said to provide mobiles, SIM to the other accused persons.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. There is no any incriminating articles or materials have been recovered from conscious possession of the petitioner. From perusal of FIR and
Patna High Court CR. MISC. No.15645 of 2023(2) dt.10-05-2023 2/2 seizure list, it appears that all mobiles, SIMs, and other articles recovered from place of occurrence which are in the name of other co-accused persons and this fact has been mentioned in para-8 of the petition. It is further submitted that other coaccused persons have already been granted bail by learned court below vide order dated 1.6.2021. Moreover, the petitioner is remanded in this case from another case and languishing in judicial custody since 20.10.2022.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Shekhopur Sarai P.S. Case No. 71 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheikhpura.
