JUSTICE SANJAY PRIYA ORAL ORDER 10-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in Bhagalpur G.R.P.S.Case No.161/16 registered for the offence and Section 30(A) of Bihar State Liquor Ban Excise Act, 2016.

It is alleged in the written report that 40 bottles of 180 Ml. of foreign liquor has been recovered from the possession of the petitioner while he was traveling in Sahebganj Jamalpur Passenger Train. He is in custody since 19.11.2016. As per paragraph 3 of the petition the petitioner has got no criminal antecedent.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, above named,

Patna High Court Cr.Misc. No.8712 of 2017 (2) dt.10-03-2017 2/2 be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C. J.M., Railway, Bhagalpur, in Bhagalpur G.R.P.S.Case No.161/16, subject to the condition that both bailers shall be the close relative of the petitioner.
