In this case, the petitioner is seeking anticipatory bail in connection with Maker P.S. Case No.09 of 2019, registered for the offence under Sections 188, 272, 273 of the Indian Penal Code and Sections 30, 30(a), 41 and 47 of the Bihar Prohibition and Excise Act, 2016.

A car was intercepted, from there 86.400 liters of English wine has been recovered. The occupant was arrested, who disclosed the name of the petitioner.

Learned counsel for the petitioner submits that the petitioner was not arrested, but the co-accused has disclosed his name.

Patna High Court Cr.Misc. No.10090 of 2019(2) dt.20-02-2019 2/2 Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court and also considering the fact that co-accused, who was arrested, has been granted regular bail.
