JUSTICE SATYAVRAT VERMA ORAL ORDER 11-03-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in connection with Saraiya P.S. Case No. 594 of 2019 instituted for the offences under Sections 272 and 273 of the Indian Penal Code read with Sections 30(a) and 30(d)(f) of the Bihar Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 29.11.2021, charge-sheet has been submitted in the case and has antecedent of one case. Allegation is of recovery of articles meant for preparing liquor from a poultry farm.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot nor the poultry farm

Patna High Court CR. MISC. No.11540 of 2022(2) dt.11-03-2022 2/2 belongs to him. It is submitted that the name of the petitioner was disclosed by the villagers with whom petitioner was on an inimical term.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case, was not arrested from the spot and in the nature of allegations, let the petitioner above named be released on bail on furnishing bail bond of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise) Court No.II, Muzaffarpur in connection with Saraiya P.S. Case No. 594 of 2019.
