Petitioner is languishing in custody for the offences punishable under Sections 411 and 120 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. One iron pointed rod was allegedly recovered from the possession of the petitioner which was to be used for house breaking and commission of theft.
Petitioner has stated that he has got no criminal antecedent, save and except Lutua P.S. Case No. 14 of 2016. Nothing else has been recovered from the possession of the petitioner and he is in custody since 18.11.2016. Considering the entire aforesaid facts, let petitioner,
Patna High Court Cr.Misc. No.15184 of 2017 (4) dt.08-05-2017 2/2 above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya/Successor Court, in connection with Lutua P.S. Case No. 15 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
