2. The petitioner apprehends his arrest in connection with the Jadopur P.S. Case No. 286 of 2023 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

3. As per prosecution case, 405 litres of country made liquor was recovered from a boat.

4. Learned counsel for the petitioner submits that petitioner is innocent and his name surfaced in this case on the ground of secret information. It has also been submitted that no recovery has been made from the physical or conscious possession of the petitioner and the mandatory provisions of the Cr.P.C. have also been violated as the seizure list has not been signed by any independent witness. 5. Learned APP for the State opposes and submits that the petitioner has three criminal antecedents of the same nature.

6. Taking into consideration the facts and circumstances, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Jadopur P.S. Case No.286 of 2023, subject to the condition as laid down under Section 482 (2) of the B.N.S.S., with further conditions that:- (i) The petitioner shall cooperate in the investigation and trial;

(ii) The petitioner shall desist from committing any such criminal offence again, failing which the State shall be at liberty to take steps for cancellation of bail bonds. (Sunil Dutta Mishra, J) khushbu/- U T
