The petitioner apprehends his arrest in connection with Lalganj P.S. Case No. 371 of 2018, registered under Sections 30(i), 32(2), 41(i) of the Bihar Excise and Prohibition Act, 2016. The allegation against the petitioner is that on secret information the police raided the house of one Harendra Singh and on search recovered huge quantity of illicit liquor. Thereafter, Harendra Singh disclosed that huge quantity of illicit liquor is also kept hidden in hut of the petitioner. Then the police raided the hut of the petitioner and on search recovered 762.84 liters of illicit liquor from his hut. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence in the manner

Patna High Court CR. MISC. No.17685 of 2019(3) dt.16-07-2019 2/2 alleged and has falsely been implicated in the present case due to village political rivalry.

After having heard learned counsel for the parties and taking into consideration the fact that huge quantity of illicit liquor has been recovered from hut of the petitioner and on the perusal of the FIR, prima facie case under the Excise Act is made out against the petitioner, I am not inclined to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail to the petitioner is hereby rejected.
