JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 302/34 of the Indian Penal Code.
It is alleged by the informant that the petitioner and his father took her husband in the night and in the morning when she got up, she found the dead body of her husband with injuries. It is submitted by learned counsel for the petitioner that none saw the petitioner in the company of the victim. There is no eye witness to the injuries being caused to the victim. The FIR suggests that the dead body was kept inside the house but the inquest report suggests that it was kept at the outer portion of the house.
Patna High Court Cr.Misc. No.7350 of 2014 (3) dt.09-02-2015 2/2 The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Baruraj P.S. Case No. 86 of 2013 pending in the court of learned SDJM, West, Muzaffarpur. This application is disposed of with the aforesaid observation/direction.
