JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 04-10-2016 Petitioner will file an application before the concerned authority for consideration for grant of benefit of promotion as graduate trained on the basis of such an application being filed with supporting materials. He will surely not be granted benefit of promotion on the basis of Sahityalankar because that is non est degree in the eye of law and not equivalent to graduation. However, if he has acquired a Post-graduation degree, then the State authorities will also verify whether the petitioner was on leave and not drawn any salary for the period he had pursued his studies as a regular student of Post-graduation from B.R.A.Bihar University, as has been submitted by him before the Court. A decision thereafter will be taken within a period of four months on
Patna High Court CWJC No.9179 of 2014 (2) dt.04-10-2016 filing of such an application after verification of the service record of the petitioner.
