JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-03-2017 This is an application for grant of bail for offences punishable under Sections 30(a) and 38 of the Bihar Prohibition and Excise Act, 1916.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case. Though there is recovery of 210 litres of country made liquor but two persons were apprehended on the spot and recovery was not made from the possession of the petitioner rather it has been recovered from the dickey of the car. Petitioner is in custody for two months. Heard learned A.P.P. also.
Having heard both sides and in view of recovery of 210 litres of country made liquor, I am not inclined to grant bail to
Patna High Court Cr.Misc. No.13683 of 2017 (4) dt.28-03-2017 2/2 the petitioner, the same is rejected.
However, learned court below, i.e., A.C.J.M, Aurangabad, is directed to expedite trial of the petitioner in connection with Nabinagar P. S. Case no. 23 of 2017 and conclude the same within a period of three months from the date of receipt/production of a copy of this order. If the trial is not concluded within the period aforesaid, petitioner is at liberty to renew his prayer for bail.
Accordingly, this application is dismissed.
