Petitioner seeks bail in connection Ghorasahan (Lakhaura) P.S. Case no. 249 of 2020 registered for the offence punishable under sections 147, 148, 149, 120B, 307, 326 of the Indian Penal Code read with section 27 of the Arms Act. The allegation, as per the first information report, is that the petitioner along with other accused persons armed with lethal weapons, surrounded the father of the informant and coaccused Gaurav Tiwary ad Ram Narayan Prasad fired upon father of the informant due to which father of the informant sustained bullet injuries in his shoulder and abdomen. Learned counsel for the petitioner submits that

No.21309 of 2021(2) dt.16-11-2021 2/2 petitioner has been falsely implicated in this case and from perusal of the FIR, it would manifest that no overt-act has been alleged against him and he is in custody since 30.06.2020 and co-accused Birendra Tiwari who is similarly situated like the petitioner has been granted bail by this court vide order dated 22.6.2021 in Cr. Misc. no. 4043/2021.
Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is in jail custody since 30.06.2020, charge sheet has been submitted and similarly situated co-accused has been granted bail, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge VIII, East Champaran, Motihari in Sessions trial no. 194/2020 arising out of Ghorasahan (Lakhaura) P.S. Case no. 249 of 2020. (Satyavrat Verma, J) s.hassan/- U T
