The petitioner seeks bail in connection with Raghunathpur P.S. Case No. 192 of 2020 instituted for the offences under Sections 30(a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 16.12.2021, charge-sheet has been submitted in the case and has antecedent of four cases and allegation is of recovery of 250 liters of liquor from a gallon. Learned counsel for the petitioner submits that petitioner was not arrested from the spot and came to be implicated in the case based on secret information received by the police. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 16.12.2021, charge-sheet has been submitted in the case and petitioner was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 4000/- (Rupees Four Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II cum Special Judge, Excise, Siwan in connection with Raghunathpur P.S. Case No. 192 of 2020.
