The petitioner apprehends his arrest in Complaint Case No. 1677 of 2013, registered for the offences punishable under Section 498(A) and other Sections of the Indian Penal Code. The complainant alleged that she was married to Jagannath Sah in the year 2004, but her husband died in the year 2013. Even during the time of her husband her father-in-law and other in-laws subjected to her different sorts of torture and on account of such, her husband died in an accident. She further alleged that after death of her husband, the petitioner and other in-laws tried to outrage her modesty. Learned counsel for the petitioner submits that the complainant made filthy allegations against the father-in-law in her complaint petition and disclosed that after death of her husband the

Patna High Court Cr.Misc. No.5313 of 2015 (2) dt.09-02-2015 accused persons drove her out from the house after snatching her belongings. The complainant got two children. It appears that after nine years of marriage the complainant filed this complaint petition after the death of her husband but she did not file any complain during the life time of her husband about the ill-treatment at the hands of the petitioner. It is submitted that the complainant wanted to get undue share in the ancestral property and that is why this case has been filed.

Considering the facts aforesaid and the fact that the petitioner is father-in-law of the complainant, he, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Basant Kumar, the learned Judicial Magistrate Ist Class, Madhubani in connection with Complaint Case No. 1677 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
