JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Samho P.S. Case No. 03 of 2018, registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is of killing the father of the informant.

Submission of learned counsel for the petitioner is that he has been made accused only on the basis of suspicion and the material collected during investigation in the case diary disclosed that there is no eye-witness to the occurrence. Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner stating that petitioner is accused in several cases, which has come in paragraph-81 of the case diary.

No.13705 of 2019(3) dt.30-04-2019 2/2 Having heard both sides and from perusal of paragraph-81 of the case diary it appears that petitioner is accused in eight other cases, which fact the petitioner has suppressed, as such, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered on its own merit. With the above observation, this application is dismissed.
