Petitioner seeks regular bail in connection with Bhabua P.S. Case No. 73 of 2019 registered for the offence under section 363 of the Indian Penal Code pending in the Court of C.J.M., Bhabua at Kaimur and subsequently section 364(A) of the Indian Penal Code was also added.

Learned counsel for the petitioner submits that earlier prayer of the petitioner for bail was rejected on merit by this Court vide Cr. Misc. No. 36860 of 2019 on 11.09.2019. Petitioner is in custody since 02.03.2019.

Patna High Court CR. MISC. No.12334 of 2020(2) dt.09-09-2020 -2Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending that there is no fresh ground in the present case. Further, he submits that on perusal of the status report, as called for from the learned court below, it appears that the trial is in progress. Having considered the above facts and circumstances of the case and the submission advanced on behalf of the State, prayer of the petitioner for bail is rejected. However, Trial Court is directed to conclude the trial within a period of six months.
