The petitioner seeks bail in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

On secret information, a raid was conducted in the house of petitioner and 21 liters of country-made liquor has been recovered from the possession of wife of petitioner and this petitioner is alleged to have fled away from the house. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Recovery has been made from the house, which is in joint possession of family. Petitioner claims clean antecedent and he is in custody since 17.01.2022. Investigation is complete.

Patna High Court CR. MISC. No.11381 of 2022(2) dt.29-04-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the quantity of recovery, clean antecedent and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.1, Muzaffarpur in connection with Gaighat P.S. Case No. 290 of 2021.
