The petitioners seek bail in Sasaram Rail P.S. Case No. 138/2016, registered for the offences punishable under Sections 401 and 34 of the Indian Penal Code and Section 37(b) of the Excise Act and Section 147 of the Railway Act. The petitioners were apprehended on the platform of Sasaram Railway Station and from their possession blades were recovered. The petitioners were found in drunken state. It is submitted that the petitioners are in jail since 24.12.2016 and no stolen articles were recovered from their possession. The Petitioners have already remained in jail for more than two months.

No.10993 of 2017 (2) dt.07-03-2017 2/2 Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Gaya in connection with Sasaram Rail P.S. Case No. 138/2016.
