This is an application for bail in connection with Pipariya P.S.Case No. 58 of 2015 registered for the offences punishable under Sections 302, 201, 120B/34 of the Indian Penal Code and 27 of the Arms Act.
Allegation against the petitioner is that he along with other co-accused had called the deceased and further allegation is that petitioner and other co-accused have taken toddy and thereafter the deceased was killed.
It has been submitted on behalf of the petitioner that no specific overt act has been attributed to the petitioner and later on it appears that other co-accused had called the deceased and petitioner is in custody for more than five months. It has further
Patna High Court Cr.Misc. No.16118 of 2017 (3) dt.01-05-2017 2/3 been submitted that co-accused having similar allegation have been granted bail by this Court in Cr.Misc.Nos. 17367, 45857 and 41929, all of 2016, vide orders dated 24.6.2016, 21.10.2016 & 17.10.2016 respectively.

Having heard both sides and considering the aforesaid facts and circumstances and also considering the fact that other coaccused having similar allegation have been granted bail, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Naresh Mathon, Judicial Magistrate, 1st Class, Lakhisarai, in connection with Pipariya P.S.Case No. 58 of 2015, subject to the conditions that :- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable properties within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to
