The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 323, 307 & 504/34 of the Indian Penal Code.

The accusation is that while the informant was cleaning the drainage, petitioners holding arms, iron rod and tangi (axe) reached there and started abusing him. On protest, petitioner no.1 assaulted on his head by means of iron rod inflicting injury on his head and when his family members rushed in his rescue they made good their escape.

Patna High Court CR. MISC. No.9168 of 2020(2) dt.28-02-2020 2/2 It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. Petitioners have been falsely implicated in this case. It is further submitted that there is no repetition of blow. So far as allegation against petitioner nos.2 & 3 is concerned, no allegation of overt act is attributed against them. Moreover, the injury sustained by the victim is simple in nature. Petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur (Bhabua) in connection with Bhabua P.S. Case No.662 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
