JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-02-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Karja Police Station Case No. 193 of 2012 registered for the offences punishable under Sections 467, 468, 471, 420 of the Indian Penal Code.
The accusation against the petitioner no. 1 is that he gave a false affidavit before the concerned authority for taking Indira Awas and in place of photograph of his wife he pasted the photograph of his sister.
Learned counsel appearing for the petitioner drew my attention towards Annexure-2 to this petition and submitted
Patna High Court Cr.Misc. No.5682 of 2015 (2) dt.11-02-2015 2/2 that inadvertently the photograph of petitioner no.1's sister was pasted and a certificate to that effect was issued by the concerned Mukhiya and it is an admitted position that on the petition of aforesaid Mukhiya the present case has been lodged against these petitioners.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st class, Muzaffarpur in Karja Police Station Case No. 193 of 2012, subject to condition as laid down under Section 438(2) of the Cr.P.C.
