JUSTICE BIRENDRA KUMAR ORAL ORDER 18-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 366A/34 of the Indian Penal Code.
The F.I.R. was lodged on missing of Chanda Kumari, the victim girl. The victim girl in her statement under Section 164 Cr.P.C. has stated that she has voluntarily married with the petitioner and she had voluntarily gone with the petitioner.
Considering the statement of the victim girl, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like
Patna High Court Cr.Misc. No.18274 of 2017 (2) dt.18-04-2017 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Banka/Successor Court, in connection with Amarpur P.S. Case No.482 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
