JUSTICE BIRENDRA KUMAR ORAL ORDER 01-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 376 of the Indian Penal Code. Bibi Rahena, the mother of the petitioner, lodged Jokihat (Mahalgawn) P.S. Case No.114 of 2000 against the informant of this case and others for the offences under Sections 341/342/323/504/34 of the Indian Penal Code on 10.07.2000. Thereafter, the same informant lodged Complaint Case No.1479 of 2000 on 01.08.2000 against the brothers of this informant for the offences under Sections 376/511/120B of the Indian Penal Code. Thereafter the present complaint case has been filed with

Patna High Court Cr.Misc. No.8650 of 2017 (2) dt.01-03-2017 2/2 allegation that two months back the petitioner had committed rape on the complainant.

Submission is that just to pressurize in the earlier case the false complaint is there.

Considering the background of the allegation, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria/Successor Court, in connection with Complaint Case No. 1951C of 2000.
