The petitioner apprehends his arrest in connection with Special Case No. 5477 of 2020, arising out of P.R. No. 99 of 2020, registered for the offence punishable under Sections 30 (a), 32(1), 32(3), 41(1), 41 of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The petitioner is the owner of the Tempo from which recovery was made on the bridge. It is contended by the learned counsel for the petitioner that she being the owner, she can not drive the Tempo herself and it was given to the driver to drive. But, if, any illegal act has been committed, it has been committed by the driver and the petitioner has no role in it. The petitioner has a clean antecedent.

No.21278 of 2021(2) dt.03-12-2021 2/2 Under the above facts and circumstances, let above named petitioner, in the event of her arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 99 of 2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
