The present application has been filed for modification of order dated 06.10.2010, passed in Cr. Misc. No. 30540 of 2010 to the extent of extending the period of surrender as the petitioners were granted anticipatory bail vide order dated 06.10.2010 passed in Cr. Misc. No. 30540 of 2010 in Wazirganj P.S. Case No. 79 of 2008 registered for the offences punishable under Sections 498(A), 323, 494, 120(B)/34 of the I.P.C. and 3⁄4 of the D. P. Act. The petitioners are the mother and brother of the husband of the informant.

It appears that the petitioners were granted anticipatory bail on 06.10.2010 vide Cr.Misc. No. 30540 of 2010 thereafter the order was modified and

Patna High Court Cr.Misc. No.5603 of 2015 (2) dt.03-03-2015 2 / 2 period of surrender was extended vide order dated 05.07.2013 passed in Cr.Misc. No. 27635 of 2013. Now the second modification application has been filed on the ground that the petitioners were suffering from some serious ailment.

This Court is not inclined to entertain the present modification application.

The present modification application is disposed off with liberty to the learned court below to consider the prayer for regular bail of the petitioners keeping in view of the fact that the petitioners were granted anticipatory bail on merits, if the petitioners surrender within a period of six weeks from the date of receipt/production of copy of the order in connection with Wazirganj P.S. Case No. 79 of 2008, pending in the court of the learned C.J.M. Gaya.
