Learned counsel for the petitioner submits that in the given facts and circumstances he may be given liberty to approach the District Magistrate, Madhepura (Respondent No. 2) to prefer an appeal in terms of Clause 32 of the Bihar Targeted P.D.S. (Control) Order, 2016 (hereinafter referred to as the "Control Order, 2016") .

Learned counsel for the State has no objection to the same.

This Writ Application is being disposed of with a

Patna High Court CWJC No.19292 of 2018(2) dt.27-07-2019 2/2 liberty to the petitioner to file an appropriate application/appeal before the District Magistrate, Madhepura (Respondent No. 2) within a period of 30 days from today.

In case, such an appeal is preferred within the stipulated period, the same will be considered by the respondent no. 2 after hearing all concerned and it will be disposed of within a maximum period of 90 days from the date of receipt/production of a copy of this order.
