JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Mithanpura P.S. Case No. 259 of 2014 registered for the offences punishable under Sections 406, 467, 468, 471 and 120B/34 of the Indian Penal Code.
Allegation as per FIR is that son of informant has purchased a land from the petitioner and got it mutated and was in possession over the land. However, later on some other purchaser of the said land has come and told the petitioner that he purchased the land from other vendor and petitioner has taken excess amount from the son of the informant which he did not return. Submission of learned counsel for the petitioner is that after investigation it appears that final form has been submitted showing the case relates to civil dispute but on protest petition
Patna High Court CR. MISC. No.18862 of 2019(4) dt.20-06-2019 2/2 cognizance has been taken and he has falsely been implicated in this case.
Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail on the ground that petitioner has suppressed the fact that some other person is also owner of the land and he has taken excess amount. In view of above facts and circumstances, let petitioner, in the event of surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, East Muzaffarpur, in connection with Mithanpura P.S. Case No. 259 of 2014, Complaint Case No. C2392/16, Tr. No. 2564/17, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
