The petitioners seek bail in a case registered under Sections 394 and 411 of the Indian Penal Code. Allegation is that the accused persons snatched the mobile phone and Rs.4500/- of the informant.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 15.11.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The alleged occurrence is said to have taken place on 12.11.2019 and the F.I.R. has been instituted on 14.11.2019. Delay has not been

Patna High Court CR. MISC. No.11527 of 2020(2) dt.28-02-2020 2/2 explained by the prosecution. Subsequently after two days merely on the basis of suspicion the petitioners were made accused in the present case.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Civil Lines P.S. case No.512 of 2019.
