2. The petitioner has prayed for bail in Danapur P.S. Case No. 195 of 2024 registered for the offence punishable under sections 386, 387 of the Indian Penal Code.
3. As per allegation in the FIR, informant is a owner of a jewellery shop at Tea point, Gola Road. On the alleged date of occurrence, it is alleged that he received ransom demanding call of Rs. Two lakh from an unknown number.
4. It is submitted by learned counsel for the
Patna High Court CR. MISC. No.11716 of 2025(3) dt.12-05-2025 2/3 petitioner that petitioner has been falsely implicated in this case. As stated by the learned counsel for the petitioner, on the alleged date of occurrence, petitioner was behind the bar. Alleged mobile Number was in the name of Ajay Kumar and on such information, his house was raided and one person was apprehended, who disclosed his name as Dev Kumar @ Dev Singh. The police took his mobile and found a whatsapp group of three member including the petitioner and on this basis, his name appeared in this case. After prevailing good sense, matter has been compromised between the parties and joint compromise petition is filed in the court below, mentioned in para 10 of the petition. After investigation, police has submitted chargesheet and charge has also been framed. Moreover, petitioner is languishing in judicial custody since 18.04.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on
Patna High Court CR. MISC. No.11716 of 2025(3) dt.12-05-2025 3/3 furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1, Danapur, Patna in connection with Danapur P.S. Case No. 195 of 2024.
