NILU AGRAWAL ORAL ORDER 06-02-2017 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners are languishing in custody since 20.12.2016 in connection with Hisua P. S. Case no. 267 of 2016 for offences punishable under Sections 30 (a) of the Excise Act. The prosecution case is that the police personnel on search found eight liters of Mahua wine in the room of the petitioners, accordingly a seizure list was prepared. It has been submitted by the learned counsel for the petitioners that they are innocent, having no criminal history and nothing has been recovered from the conscious possession of the petitioner.

Considering the facts and circumstances and the materials on record, let petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Hisua P. S. Case No. 267 of 2016.
