Petitioner apprehends her arrest in a case registered for the offence punishable under Section 420/ 34 of the Indian Penal Code and u/s 138 of N.I. Act.

It is a case of cheque bounce.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that petitioner is not the author of the cheque and she has been made accused only because she is wife of Bipin Kumar who is alleged to have issued the cheque in question. Petitioner is a lady and she has got clean antecedent. Learned counsel appearing for the State and the O.P.

Patna High Court CR. MISC. No.12003 of 2023(3) dt.15-05-2023 2/2 No.2 opposed the prayer for anticipatory bail. Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of her arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Patna in connection with Complaint case No.3082C/ 2021, subject to conditions laid down u/s 438(2) of the Cr.
