The petitioner is languishing in custody since 25.11.2016 in connection with Jhanjharpur (Arariya Sangram) P.S. Case No. 88 of 2016, G.R. No. 991 of 2016 for the offences instituted under Section 392 of the IPC.
The prosecution story, in brief, is that while the informant alongwith his friend was returning home, three persons stopped him and fired upon him. The miscreants snatched his motorcycle, three mobiles, cash of Rs. 4,000/- and other articles and fled away.
It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.9372 of 2017 (2) dt.16-03-2017 2/2 petitioner is in custody since 25.11.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. He has got no criminal antecedent. He is not named in the FIR. He has not been put on T.I. Parade. There is no recovery of any incriminating article from possession of the petitioner.
On behalf of the State, it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jhanjharpur, Madhubani, in connection with G.R. No. 991 of 2016, arising out of Jhanjharpur (Araria Sangram) P.S. Case No. 88 of 2016.
