JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-06-2016 The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code.

The basic accusation is of torture.

The prosecution case is that the informant was earlier married with one Uday Chouhan, the elder brother of the petitioner, who died and, subsequent to his death, the informant claims to have married with the petitioner. Though the impugned order suggests that it was submitted by learned counsel for the petitioner that the petitioner is ready to keep the informant with dignity and honour but now the petitioner denies the factum of marriage.

It is submitted by learned counsel for the informant that informant is ready to resume the conjugal life. Considering the nature of accusation and the

Patna High Court Cr.Misc. No.6064 of 2016 (3) dt.27-06-2016 2/2 inconsistent stand of the petitioner, this Court is not inclined to confer the privilege of anticipatory bail. Let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Noorsarai P.S. Case No. 232 of 2015, pending in the Court of learned Sub-Divisional Judicial Magistrate, Nalanda at Biharsharif.

With the observations above, the application stands disposed off.
