The petitioner apprehends his arrest in Mahnar P.S. Case No. 245 of 2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. The informant named the petitioner along with other accused persons and alleged that all the accused persons assaulted the brother of the informant with knife. The petitioner is alleged to have stabbed in the chest of Suresh Sahni.
Submission is that the petitioner is on inimical term. There is land dispute from before and that is why the petitioner has falsely been implicated.
It appears that there is very specific allegation against the petitioner that he was leading the mob and gave dagger blow
Patna High Court Cr.Misc. No.6480 of 2015 (2) dt.18-02-2015 2/2 in the chest of Suresh Sahni.
Considering the facts aforesaid I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
