The petitioner seeks regular bail in registered for the offences punishable under sections 363/365 in which charge sheet has been submitted u/s 364/302/201/120(B)/34 of the Indian Penal Code.

As per FIR, son of the informant had gone to attend tuition classes but he did not return.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation in the confessional statement of co-accused, Ranjit Kushwaha. No incriminating article has been recovered from the possession of

Patna High Court CR. MISC. No.10822 of 2022(2) dt.05-05-2022 2/2 the petitioner and till date the petitioner has not been put on Test Identification Parade. Petitioner claims clean antecedent and is in custody since 12.08.2021 and investigation in this case is complete.

Learned counsel for the State and the informant vehemently opposed the prayer for bail and submitted that copy, book and ATM card of the deceased have been recovered from the back side of petitioner's house.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
