JUSTICE HARISH KUMAR ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 23-02-2024 The above Public Interest Litigation seeks legal action against the guilty government officers and employees of Nagar Parishad, Madhubani, which is now a Municipal Corporation. It is pertinent that none of these officers have been impleaded in the above writ petition.

2. It is asserted in the writ petition that there were financial irregularities committed against which an inquiry was constituted with a team of five members. The District Public

Patna High Court CWJC No.3509 of 2024 dt.23-02-2024 2/2 Grievance Redressal Officer, who was the Chairman of the investigation team, it is stated, filed Annexure-2 report specifically on 43 points, raised by the petitioner wherein he has found defalcation of amounts.

3. There are also other persons named in the writ petition, none of whom are impleaded in the writ petition.

4. Broad allegations are made based on an Inquiry Report which is also dated 25.03.2023. No precipitate action can be directed to be taken in the above writ petition filed as a Public Interest Litigation; without any of the parties against whom allegations are raised in the party array. Even the Municipal Corporation has not been made an eo nomine party in the writ petition.

5. We find absolutely no reason to entertain the writ petition and dismiss the same.
