The petitioner apprehends her arrest in Dharahara P.S. Case No. 175 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and Sections 3(x) of the S.C./S.T. Act.
Manoj Kumar Paswan the A.S.I. alleged that when he went for investigation of Dharahara P.S. Case No. 171 of 2014, the petitioner abused him by naming his caste, on such her son Mithun Sharma and others assaulted the informant and other police officers.
Learned counsel for the petitioner submits that the petitioner is a lady. She does not know how to read. There is no allegation of assault against the petitioner.
Patna High Court Cr.Misc. No.5467 of 2015 (2) dt.10-02-2015 Learned Special PP has submitted that there is very specific allegation against the petitioner that she abused the informant.
On considerations of the fact that there is no allegation of assault against the petitioner and the petitioner is a lady, she, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Dharahara P.S. Case No. 175 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
