The petitioners seek bail in anticipation of their arrest in connection with Kesariya P. S. Case No. 439 of 2018 dated 21.10.2018 instituted for the offences under Sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code.

The petitioners along with others are said to have assaulted the informant and his associates in the occurrence. As far as the petitioners are concerned, it has been

The specific accusation of assault is against Laxman Mahto and Yadu Lal Mahto @ Rigan Mahto. The injuries suffered by the victims have been opined to be simple in nature. Regard being had to the aforesaid facts as also taking into account the clean antecedents of the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-3, East Champaran, Motihari in connection with Kesariya P. S. Case No. 439 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
