JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-02-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.
The accusation is of kidnapping the minor daughter of the informant.
In 164 Cr. P.C. statement, the victim got her age recorded as 16 years whereas the court assessed her age as 17 years where she stated that she herself went in the company of Isiyak Hussain and she was never been kidnapped. The petitioners are the parents and brother of Isiyak. A statement has been made
Patna High Court Cr.Misc. No.5393 of 2015 (2) dt.10-02-2015 2/2 in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Muzaffarpur in connection with Kaji Mohammadpur P.S.
