In the instant petition, petitioner has prayed for following reliefs:- "That the present writ application is for issuance of writ in the nature of writ of certiorary quashing the memo no. 547 dated 17.6.2015 by which the respondent authority without asking show cause notice and without giving sufficient opportunity to the petitioner illegally relieved from work and allotted to another person and further

2/4 issuance of writ in the nature of writ of mandamus directing and commanding the respondents to pay the outstanding amount of 2 years to the petitioner with respect to work performed by him in the SubDivisional Hospital Balia on the basis of work order passed by Civil Surgeon cum Member Secretary District Health Society Begusarai and pass such other order/orders/Direction/s for which the petitioner is entitled."

3. Annexure- 3 reads as under:- "

1. कतायर्यादकश कक अनुसतारि कतायर्ति समंतकषपद नहहीं पताए जतानक कक कतारिण कतायर्तिरित लदव्य लकरिण सतामतालजक सकवता समंस्थतान कक आदकश लनगर्तित कली लतलथ सक कतायर्तिमनुक्त करि लदयता जताय।

2. Jh लवकतास कनुमतारि जक सदरि अस्पतताल में सफताई कता कतायर्ति करि रिहक ह, कक बललयता में सफताई कपड़k धिनुलताई पलरिसरि कता रिख-रिखताव एवमं आपूलतर्ति कता कतायर्ति क्रमशशः 0 52,000.00 (बतावन हजतारि पलत मताह) एवमं 50/- पलत भतर्ती मरिलीज कक दरि परि कतायर्यादकश लदयता जताय।

3. शली लवकतास कनुमतारि आदकश लनगर्तित कली लतलथ सक कतायर्यारिमंभ करि दमें। एक महलीनक कक कतायर्ति सतकषपद पमताण पत पभतारिली लचिलकत्सता पदतालधिकतारिली एवमं अस्पतताल पबमंधिक कक समंयनुक्त हस्तताक्षरि सक पकषण कक उपरितान्त अनुबमंधि लकयता जताय। लसलवल सजर्तिन -सह- सदस्य-सलचिव लजलता स्वतास्थ्य सलमलत, बकगपूसरिताय। "

4. In the counter affidavit respondents have not specifically taken contention that the petitioner was heard before passing impugned order dated 17.06.2015 (cited supra). Even the final order do not reveal as to whether petitioner has been heard in the matter, like issuance of show cause notice and seeking explanation of the petitioner. In fact, petitioner has specifically contended that the impugned action is without show cause notice.

5. In the light of these facts and circumstances, petitioner has made out a case. Accordingly, Annexure-3 dated

4/4 17.06.2015 stands set aside. The present writ petition stands allowed reserving liberty to the concerned respondent to proceed in accordance with law within a period of four weeks.

6. The concerned authority is hereby directed to take note of Apex Court's decisions rendered in the case of UMC Technologies Pvt. Ltd. vs. Food Corporation of India and Another, reported in (2021) 2 SCC 551 read with Isolators and Isolators through its Proprietor Mrs. Sandhya Mishra Vs. Madhya Pradesh Madhya Kshetra Vidyut Vitran Co. Ltd & Another reported in 2023 LiveLaw (SC) 330 (para 34) before taking further action in the matter.
