Learned counsel for the petitioners is expected to honour his undertaking to remove the defects as pointed out by the office when called upon to do so by the office. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Chautham P.S. Case No. 130 of 2020 instituted for the offences under Sections 147, 149, 447, 448, 341, 323, 307, 504

Patna High Court CR. MISC. No.21234 of 2021(2) dt.20-12-2021 2/3 and 506 of the Indian Penal Code.

As per allegation in the FIR, the petitioners were damaging the tat of the informant on his purchased land and when protested, he was assaulted by the petitioners with lathi and iron rod.

Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have got no criminal antecedent. There was case and counter case. Both the parties sustained injuries in the scuffle. However, good sense prevailed and both parties entered into compromise and compromise petitions have been filed by them, which are annexed as Annexure-4 series. Having heard learned counsel for the parties and in the facts and circumstances of the case and the compromise petitions filed by both the parties, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Chautham P.S. Case No. 130 of 2020, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Khagaria,
