2. The petitioner has preferred this application for grant of regular bail in connection with Madhepur P.S. Case no. 228 of 2025 registered under sections 115(2), 118(1), 121(2), 122(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and sections 8 and 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

3. As per the prosecution case, while one accused managed to escape, the petitioner was caught with 50 bottles of cough syrup of 100 ml each containing codeine.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case only on the basis of suspicion. No incriminating article has been recovered from the

Patna High Court CR. MISC. No.11193 of 2026(2) dt.25-02-2026 2/2 petitioner's possession. The petitioner is a young student preparing for various competitive examinations. He is in custody since 10.12.2025 and has no criminal antecedent.

5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the FIR, the petitioner being in custody since 10.12.2025 and specially not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Madhepur P.S. Case no. 228 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Principal Sessions Judge, Madhubani on the following condition:

(i) If it subsequently transpires that the petitioner had a criminal antecedent, the prosecution will be at liberty to move this Court for cancellation of bail of the petitioner. (Partha Sarthy, J) sauravkrsinha/- U T
