JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Marauna P.S. Case No. 74 of 2013 registered for the offences punishable under Sections 379/411 of the Indian Penal Code. Admittedly, the stolen article was recovered from Kabadi shop of the petitioner and after the aforesaid recovery, petitioner and his brother were made accused in the present case. It is submitted on behalf of the petitioner that brother of the petitioner has already been granted regular bail and moreover, informant has filed compromise petition. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, this

Patna High Court Cr.Misc. No.5267 of 2015 (2) dt.10-02-2015 anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Supaul in Marauna P.S. Case No. 74 of 2013 subject to condition as laid down under Section 438(2) of the Cr.P.C.
