====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 24-04-2024 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant.

2. The petitioner seeks regular bail in connection with Ahiyapur P.S. Case No. 1584 of 2023, lodged on 23.11.2023 under Sections 304(B), 34 of the Indian Penal Code.

3. As per the prosecution case, FIR has been lodged against four named accused persons including the present petitioner. The allegation against the present petitioner is that the petitioner in connivance with other family members have killed the daughter of the informant due to non-fulfillment of the demand of dowry and kept the dead body of the informant's daughter in the room.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel

Patna High Court CR. MISC. No.13812 of 2024(3) dt.24-04-2024 2/2 also submits that the petitioner is an old lady aged about 65 years and mother in law of the alleged victim. Counsel further submits that the allegation made in the FIR is not correct though son of the petitioner is already in custody. Counsel also submits that the criminal antecedent of the petitioner is clean and she is in custody since 24.11.2023.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. Learned counsel for the informant vehemently opposes the prayer for bail of the petitioner and submits that in commission of the dowry death, there is involvement of the petitioner also.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 1584 of 2023, subject to the conditions as laid down U/s 437(3) Cr.P.C. (Dr. Anshuman, J.) Divyansh/- U
