The petitioner seeks bail in connection with Arrah Rail P.S. Case No.114 of 2016 registered under Sections 379/34 of the Indian Penal Code.

The accusation is that on 25.11.2016 in the evening, the informant alongwith his family boarded at Patna-Bhabhua Intercity Express at Arrah Railway Station for going to Patna. When the train moved from Arrah Railway Station then one boy started to flee away snatching the ladies purse of the informant. Thereafter, on the alarm, raised by the informant, the husband of the informant and her son tried to catch hold of that boy but, in the

Patna High Court Cr.Misc. No.4901 of 2017 (2) dt.06-03-2017 2/2 meantime, that boy gave the purse to another boy, who was, later on, apprehended and disclosed his name as Sudhir Kumar (petitioner).

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the petitioner was apprehended by the husband and son of the informant at the time of snatching the ladies purse of the informant but the petitioner was not found with the snatched ladies purse of the informant rather the same was handed over to the petitioner by his associate, who succeeded to flee away. In fact, the petitioner was present at the Railway Station and he was apprehended on mere suspicion. The petitioner having no criminal antecedent is in custody since 26.11.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Railway, Bhojpur at Arrah, in connection with Arrah Rail P.S.
