JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-06-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Special Case No. 83 of 2016 arising out of Jakkanpur P.S. Case No. 286 of 2016 for the offence under sections 20B of N.D.P.S. Act and Sections 30(A)/38 of Bihar Excise Amendment Act, 2016. The petitioner is in custody since 31.10.2016. From the FIR, it appears that the petitioner was apprehended along with two other persons and 50 Purias of Ganja and 8 bottles of Royal stage whisky containing 180 Ml. was recovered from his possession.

It appears that co-accused Pappu Kumar @ Munna from whose possession 100 purias of Ganja was recovered, was granted bail by this Court in Cr. Misc. No. 12490 of 2017 vide

Patna High Court Cr.Misc. No.8901 of 2017 (3) dt.06-06-2017 2/2 order dated 22.03.2017.

Having regard to the period of custody of the petitioner and the fact that similarly circumstanced other coaccused was granted bail by this Court in Cr. Misc. No. 2490 of 2017 on the ground of parity, I am inclined to enlarge the petitioner, named above on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-III, Patna, in connection with Special Case No. 83 of 2016, arising out of Jakkanpur P.S. Case No. 286 of 2016 on the condition that the petitioner will extend full cooperation in the trial and will not, in any manner, influence the evidence or the witnesses.
