Petitioner seeks bail in Dhangai P.S. Case No.22 of 2019 registered under Section 380 of the IPC. The F.I.R. was lodged against unknown for theft of Samsung LCD TV and other electronic items, which were stolen from the school. The name of the petitioner figured in the case during course of investigation in the confessional statement of Pankaj Kumar. On the basis of confessional statement of Pankaj Kumar, one Exide battery was recovered from the house of the petitioner and one i20 Hyundai car was also recovered from which the electronic items were transported from the school after committing theft.

Learned counsel for the petitioner submits that Pankaj Kumar and other accused persons have already been enlarged on

Patna High Court CR. MISC. No.9625 of 2020(3) dt.02-06-2020 2/2 bail. The petitioner is in jail since 24.11.2019. The petitioner has already remained in jail for more than six months and he has got no criminal antecedent.

Having considered the nature of allegations and the fact that the petitioner has remained in jail for more than six months and he has got no criminal antecedent, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M., Sherghati (Gaya) in connection with Dhangai P.S. Case No.22 of 2019.
