This application has been filed for restoration of Cr. Misc. no. 33867 of 2014 which was dismissed for default due to non-compliance of the order dated 13.8.2014.

It is submitted that due to mistake there has been delay in filing the requisites for issuance of notice on opposite party no. 2 under both process (ordinary and registered cover with A/D) and the same has been filed on 21.8.2014. There is no deliberate laches on the part of the petitioner.

Considering the facts and circumstance, Cr. Misc. no. 33867 of 2014 is restored to its original file. This application stands allowed.
