JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-03-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Mainatand Police Station Case No. 41 of 2015, disclosing offences under Section 414 of the Indian Penal Code, Sections 11 (I) (a), 11(I)(d) and 11(I)(k) of the Prevention of Cruelty to Animal Act, 1960, and Sections 23/26 of the J. J. Act.

Having perused the order dated 13.10.2015 passed in Criminal Misc. No. 41381 of 2015, whereby the petitioner's application for anticipatory bail was rejected by this Court, I am not inclined to entertain the present second anticipatory bail application in connection with the same

Patna High Court Cr.Misc. No.6781 of 2016 (2) dt.14-03-2016 2/2 case as I do not find any reason to entertain the second anticipatory bail application.

This application for anticipatory bail is accordingly rejected.

However, if the petitioner, Mahadeo Yadav, appears before the Court below within a period of two weeks from today and seeks regular bail, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present second application for grant of anticipatory bail.
