The petitioner seeks bail in connection with Banka P.S. Case No. 293 of 2025 instituted for the offence under Section 109 of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

The prosecution case, in brief, is that on 07.07.2025 at about 3:00 P.M., while the informant was returning to his house from the residence of Bhola Yadav, the petitioner, namely, Kranti Yadav, allegedly fired at the informant with a country-made pistol, causing a gunshot injury to his chest.

It has been submitted on behalf of the petitioner
Patna High Court CR. MISC. No.11425 of 2026(8) dt.13-07-2026 2/3 that the petitioner is in custody since 08.07.2025. Petitioner bears no criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case due to previous enmity and with an intention to wreak vengeance. It is submitted by petitioner's counsel that the alleged occurrence arose out of a minor altercation during which the informant sustained injuries, and the allegations against the petitioner are exaggerated and motivated. Learned counsel further submits that the informant was earlier arraigned as an accused in Complaint Case No. 486 of 2025 instituted from the petitioner's side under Sections 137(b) and 87 of the BNS and Section 27 of the Arms Act, which provides the motive for the present false implication. It is also submitted that the petitioner's daughter-in-law had previously instituted a case against the informant alleging that he had attempted to elope with her, and owing to the said dispute and the existing animosity between the parties, the present case has been maliciously instituted as a counterblast.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case and period of custody of the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Banka P.S. Case No. 293 of 2025, subject to the following conditions: (I) One of the bailors shall be own/close member of the family of the petitioner.
(II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.
