JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 3 of the R.P.(U.P.) Act and Section 174 of the Railway Act. The accusation is of committing theft of coal from the railway wagon parked in the railway yard when one co-accused Bhuna Yadav was arrested on the spot from whose possession, the coal was recovered.

It is alleged that four persons escaped from the scene including the petitioner.

Learned counsel for the petitioner submitted that only on suspicion, the accusation has been levelled and there is no recovery from the petitioner.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Patna High Court Cr.Misc. No.8986 of 2015 (2) dt.04-03-2015 2/2 Let the learned court below consider the prayer for regular bail of the petitioner, if he surrenders within a period of six weeks in connection with Koderma RPF Case No. 16 of 2014. Accordingly, the petition is disposed of.
